About Those School Strip Searches
PNS has recently received several questions concerning the legality of school strip searches. It's ultimately up to the courts to decide what is permissable and what isn't; however, some of the salient points are:
1. Is the student suspected of harboring a weapon?
2. Is a teacher of the same sex present?
3. How close to actual fondling is the pat down?
4. Have parents been notified?
In other words, each case is different, but what isn't classifed as a sexual assault under state law may be deemed a violation of civil rights under federal law.
